高空抛物危害大杜绝陋习靠大家
尊敬的业户：您好！近期，我管理处接到几起业户投诉，称楼上业户将东西扔下来把小轿车砸坏、将污秽之物扔到院子里或阳台上、将烟头随手下扔、更甚者将晒衣架的摇把扔到楼下险些伤人等等。尽管我管理处采取了张贴杜绝高空抛物的温馨提示，电话、可视对讲或上门直接提示的宣传方式，然而还是未能引起个别业户的重视。为此，我们再次就高空抛物问题进行全面剖析，望引起各位业户的高度重视。
一、高空抛物的危害性高空抛物是一种违反社会公共道德的行为。它不仅仅易造成人身伤害、财产损失、环境破坏，也使得邻里关系、社会风气，甚至城市形象遭到破坏。经调查有七大空中杀手，样样要人命。它们是：烟头、菜刀（以及其他铁器）、啤酒瓶（以及其他玻璃瓶）、花盆、砖石、爆竹、晾衣竿。一个300克的鸡蛋从8楼抛下来就能够让人头皮破裂，从18楼高甩下来就能够砸破行人的头骨，从25楼抛下可使人当场死亡。一个拇指大的小石块在25楼抛下时可能会让路人当场送命。一个4公分的铁钉在18层抛下时，可能会插入行人的脑中。纵使是一块西瓜皮，从25楼抛下时都可能让人当场伤命。
二、高空抛物的法律职责1、刑事职责：高空抛物在造成人身伤亡和重大财物损失的严重后果以及高空抛物者的观恶意程度，可能涉及到犯罪和追究刑事职责的问题。相应的罪名主要有：故意杀人罪、故意伤害罪，以及危险方法危害公共安全罪。2、民事职责：（1）一般状况下，高空抛物者即指加害人为一人，且已确定的状况下，加害人或其法定代理人（在加害人无行为潜力或限制行为潜力人的状况下）个人承担侵权赔偿职责。（2）《民法通则》第一百二十六条规定：建筑物或其他设施以及建筑物上的搁置物，悬挂物发生倒塌、脱落、坠落造成他人损害的，它的所有人或者是管理人应当承担民事职责，但能够证明自我没有过错的除外。即在找不到直接加害人的状况下，楼上的住户又带给不出自我无过错的证据，职责将由楼上住户群众承担。（3）共同侵权状况下，即加害人为二人或二人以上的状况，加害人除应承担一般高空抛（坠）物致人损害的侵权职责外，还应承担共同侵权所负的连带职责。3、物业公司对高空抛物引起的人身财产损害不承担赔偿职责。理由是：（1）高空抛物是行为人的故意行为，由此引起的一切职责（包括刑事职责和民事职责）由行为人承担。（2）物业管理公司在性质上是受托对小区物业实施管理，它的权力来自于法律的
规定和业主的授权。现行立法中没有授权物业管理公司采取什么措施制止高空抛物行为，所以物业管理公司无此权利潜力；同时，也没有要求物业管理公司直接承担赔偿职责的法律依据。（3）物业管理公司管理的地域范围是红线以内业主门户以外，所以物业管理公司无行为潜力，对高空抛物无法预见、难以制止。综上所述：随意高空抛物，最终难逃其咎。为此，我们呼吁：为了您和他人家庭的.幸福、安宁和生命财产安全，为了共建高尚、礼貌、和谐、整洁的完美家园，请手下留情。同时，务请注意以下事项：
1、请勿从阳台往下泼水或在阳台上冲洗衣服，以防脏水溅到楼下。
2、请勿在阳台内堆放易燃、易爆或易被风刮起的物品，也请不要在阳台边缘放置花盆等易坠物品，正在装修的单位请必须要封闭好阳台施工。
